Terms of Service

These Terms of Service ("Terms") govern your access to and use of ATLI, a data-only eSIM connectivity service (the "Service") offered through the ATLI app and https://xforgemobile.com or any other affiliated website or application (together, the "Platform"), operated by Techlogic Solutions LLC ("we," "us," or "our"). By creating an account, purchasing a data plan, or otherwise using the Platform, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the Platform or the Service.

These Terms are separate from, and do not affect, any terms and conditions that apply to other XForge products, such as the XForge Smartphone or the NOMAD 100W GaN Travel Charger, each of which is governed by its own terms.

1. The Service

Atli provides prepaid, data-only eSIM plans ("Data Plans") for use while traveling, delivered electronically to compatible mobile devices. Atli does not provide a phone number, SMS, or voice calling; it is a data-only service. The Platform includes an in-app assistant ("ATLI") that can help you choose a plan, track usage, install your eSIM, and get support.

2. Eligibility and Device Compatibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a Data Plan. You are responsible for confirming, before purchase, that your device is eSIM-compatible and carrier-unlocked. We provide compatibility information on the Platform as a convenience, but we are not responsible for verifying your specific device or carrier lock status, and Data Plans are non-refundable where a purchase fails to activate due to an incompatible or locked device, except as described in Section 8 (Refunds).

3. Account Registration

You may be asked to provide an email address and other basic information to create an account, complete a purchase, and receive support. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

4. Purchases and Payment

Data Plans are currently offered on a one-time, non-renewing purchase basis: you pay a fixed price for a fixed data allowance and validity period, and the plan does not automatically renew or recur. Prices are shown in the Platform at checkout and may include applicable taxes. We reserve the right to change Data Plan pricing at any time; changes will not affect Data Plans already purchased.

We reserve the right to refuse or cancel any order at our discretion, including where we suspect fraud, abuse, or a violation of these Terms.

5. Activation and Validity

Each Data Plan has a validity period (starting either upon installation or upon first network connection, as specified for that plan) and a fixed data allowance, both shown at the time of purchase. Unused data and unused validity time expire at the end of the validity period and are not carried over, refunded, or extended, except as required by law or as described in Section 8.

We recommend installing your eSIM before you begin travel, while you still have access to Wi-Fi, and activating it upon arrival at your destination to avoid unnecessary use of your validity period.

6. Network Coverage and Fair Use

The Service is delivered using the network infrastructure of third-party mobile network operators in each destination. Coverage, speed, and quality of service depend on those third-party networks and are outside our control; we do not guarantee uninterrupted, error-free, or particular-speed connectivity in any location.

Plans described as unlimited are subject to a fair use policy and may be subject to reasonable speed reduction after a high-usage threshold disclosed on the Platform for that plan, consistent with the practices of the underlying network operator.

7. Refunds

Data Plan purchases are final and non-refundable, except where a proven technical failure attributable to us or our network partners prevents you from activating or using the Data Plan as described (for example, a valid activation code that fails to install due to a documented platform-side error, or a total connectivity failure not caused by your device, account, or actions).

To request a refund under this Section, contact support within a reasonable time of the issue, describe the problem, and provide any diagnostic information we request (such as screenshots, error codes, or device/eSIM details) so we can investigate. Approved refunds will be issued to your original payment method. We are not able to offer refunds for issues caused by an incompatible or locked device, incorrect Data Plan selection, exceeding your data allowance, or the local network coverage available at your destination.

8. The ATLI Assistant

ATLI is an automated, AI-based assistant built into the Platform to help you select plans, install and troubleshoot your eSIM, track usage, and get answers to common questions. ATLI's responses are generated automatically and, while we aim for accuracy, may occasionally be incomplete or incorrect; ATLI is not a substitute for a human support agent, and you can request to speak with our support team at any time. Do not share sensitive information (such as full payment card numbers or passwords) in your conversations with ATLI.

9. Prohibited Uses

You agree not to: resell, redistribute, or commercially exploit a Data Plan without our written permission; use the Service for any unlawful purpose; attempt to circumvent fair use limits, geographic restrictions, or account limits through fraudulent means; interfere with the security or normal operation of the Platform; or use automated means to scrape, access, or overload the Platform outside of normal use. We may suspend or terminate your account for violating this Section.

10. Intellectual Property

All trademarks, logos, app content, and software associated with Atli, ATLI, and the Platform belong to us or our licensors. You may not copy, modify, reverse-engineer, or redistribute any part of the Platform except as necessary for your personal, non-commercial use of the Service.

11. Disclaimer of Warranties

Except as expressly stated in these Terms, the Service and Platform are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, including lost profits or lost data, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Except for approved refunds under Section 8, our total liability to you under these Terms will not exceed the amount you paid for the Data Plan giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account or access to the Service if you violate these Terms, at our reasonable discretion. Sections of these Terms that by their nature should survive termination (including Sections 8, 12, 13, and 16) will continue to apply.

14. Force Majeure

We are not liable for delays or failures in providing the Service caused by events beyond our reasonable control, including network operator outages, natural disasters, government action, or telecommunications and internet disruptions.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above, and where required by law, we will provide additional notice. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

Cookie Policy

This Cookie Policy explains how we use cookies and similar technologies (such as SDKs and mobile device identifiers) on the Platform, and is part of these Terms.

What Are Cookies

Cookies are small text files placed on your device by websites you visit. Similar technologies used in the Atli app include mobile SDKs and device identifiers that serve equivalent functions.

Categories of Cookies We Use

Essential cookies — required for core functionality, such as keeping you logged in, remembering your cart, and processing payments. These cannot be disabled without affecting the Service.

Performance and analytics cookies — help us understand how the Platform is used, diagnose errors, and improve performance.

Functional cookies — remember your preferences, such as language or currency.

Advertising cookies — used, where applicable, to measure and personalize marketing communications and promotions.

Managing Cookies

You can manage or disable non-essential cookies through your browser settings, your device's app-tracking settings, or any in-app cookie/privacy preference control we provide. Disabling certain cookies may limit some features of the Platform, such as saved preferences or personalized recommendations.

Third-Party Cookies

Some cookies on the Platform are set by third-party service providers who help us with analytics, payment processing, and marketing. These providers may use cookies in accordance with their own privacy and cookie policies.
